Terms of Service

These Terms of Service ("Terms") govern your use of Guestlyhub, a vacation rental management platform operated by Connectwork BV ("we", "our", "us"). By creating an account or using our service, you agree to these Terms.

1. The Service

Guestlyhub provides a cloud-based vacation rental management platform for vacation rental operators. The service includes tools for managing properties, reservations, guest communications, invoicing, and related tasks.

We are continuously developing and improving the platform. Features may be added, modified, or removed as the product evolves. We will make reasonable efforts to notify you of significant changes that affect your use of the service.

2. Account Registration

To use Guestlyhub, you must create an account and provide accurate, complete information. You are responsible for:

• Keeping your login credentials secure and confidential
• All activity that occurs under your account
• Notifying us immediately if you suspect unauthorized access

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization.

3. Your Data

You retain ownership of all data you enter into Guestlyhub, including accommodation information, guest data, reservations, and financial records. We do not claim any intellectual property rights over your content.

You grant us a limited license to store, process, and display your data solely for the purpose of providing the service to you. See our Privacy Policy Cookie settings for details on how we handle your data.

You are responsible for ensuring that the data you enter complies with applicable laws, including data protection regulations (GDPR) with respect to your guests' personal information.

4. Acceptable Use

You agree to use Guestlyhub only for lawful purposes and in accordance with these Terms. You may not:

• Use the service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the service or its infrastructure
• Interfere with or disrupt the service or servers
• Upload malicious code, viruses, or harmful content
• Resell, sublicense, or redistribute the service without our consent
• Use automated tools to scrape or extract data from the platform

5. Pricing & Payment

Guestlyhub offers various subscription plans as described on our Pricing page. By subscribing to a paid plan, you agree to pay the applicable fees.

• Prices are listed in euros and are exclusive of applicable taxes unless stated otherwise
• Subscriptions are billed in advance on a monthly or annual basis
• We reserve the right to change pricing with at least 30 days' notice
• Refunds are handled on a case-by-case basis; contact us if you have concerns

Failed Payments

If a monthly or annual payment fails, we will attempt to notify you. If the payment issue is not resolved, we reserve the right to suspend access to the service within 3 business days of the failed payment. Your account and data will be retained for a reasonable period to allow you to resolve the payment issue. However, if we do not receive a response or payment after repeated attempts to contact you, we reserve the right to permanently delete your account and all associated data.

6. Free Trial & Free Plans

We may offer free trials or free-tier plans. These are provided "as is" and may have feature limitations. We reserve the right to modify or discontinue free offerings at any time.

7. Hosting & Infrastructure

Guestlyhub is hosted on servers provided by Hetzner Online GmbH, located in Germany. By using Guestlyhub, you acknowledge and accept Hetzner's terms and conditions as they apply to the infrastructure on which the service operates. We are not responsible for any downtime, data loss, or other issues caused by our hosting provider.

8. Service Availability

We strive to keep Guestlyhub available 24/7 but do not guarantee uninterrupted access. The service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice when possible)
• Urgent security updates or bug fixes
• Circumstances beyond our reasonable control

We are not liable for any losses resulting from temporary unavailability of the service.

9. Limitation of Liability

To the maximum extent permitted by law:

• Guestlyhub is provided "as is" and "as available" without warranties of any kind, whether express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service
• Our total liability to you for any claims arising from or related to the service shall not exceed the amount you paid to us in the 12 months preceding the claim

Guestlyhub is a software tool only. We provide a platform for managing property data, reservations, and related administrative tasks. We are not responsible for the properties listed or managed through the platform, including but not limited to the existence, condition, legality, or accuracy of any property listing. Users are solely responsible for the properties they manage, the accuracy of the information they provide, and compliance with all applicable local laws and regulations regarding vacation rentals.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

10. Third-Party Integrations

SES Hospedajes (Spanish Guest Registration)

Guestlyhub offers a feature to submit guest registration data to the Spanish authorities via the SES Hospedajes API. This feature is provided as a convenience to facilitate the data submission process. Guestlyhub acts solely as an intermediary and is not responsible for:

• The accuracy, completeness, or legality of the data you submit through the API
• Any errors, rejections, or consequences resulting from data submissions
• Compliance with Spanish guest registration requirements — this remains your responsibility as the property operator
• Changes to the SES Hospedajes API, its availability, or its requirements

You are solely responsible for ensuring that all guest data submitted through the SES Hospedajes integration is accurate and complies with applicable Spanish regulations.

11. Termination

You may cancel your account at any time through the application or by contacting us. Upon cancellation:

• Your access to the service will continue until the end of your current billing period
• You can export your data before your access ends
• We will delete your data within 30 days after your account is closed, unless retention is required by law

We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.

12. Intellectual Property

The Guestlyhub platform, including its design, code, features, documentation, and branding, is owned by Connectwork BV and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the service as described herein.

13. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will notify you via email or through a notice in the application at least 14 days before the changes take effect. Continued use of the service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Belgium. Any disputes arising from these Terms or the use of Guestlyhub shall be subject to the exclusive jurisdiction of the courts of Belgium.
